Environmental Lien & AUL Report

The current owner search, run from the date the present owner acquired the property to today, across the city, county, state, and federal repositories that apply to the site.

The EPA’s All Appropriate Inquiry rule and the ASTM E1527-13 standard require that each site is researched for Environmental Liens and Activity and Use Limitations (AULs) as part of a Phase I Environmental Site Assessment (ESA).

These types of documents are recorded in various government repositories. We research documents located at the City, County, State and Federal levels when conducting an Environmental Lien and AUL report. We will search the property using both grantor and grantee indexes, as well as documents recorded against the subject parcel, from the point the current owner purchased the property, to present.

Working to the newer standard instead

If your assessment is written to ASTM E1527-21, the current owner search on its own no longer satisfies the requirement. Either pair this report with the previous title insurance policy for the property, which we will review for AULs at no additional cost, or order the 1980 Environmental Lien & AUL search. News & Announcements

American Society for Testing and Materials Standards Update

In November of 2021, the United States Environmental Protection Agency approved the most recent American Society for Testing and Materials Standard E1527-21 as sufficient to satisfy “All Appropriate Inquiry” for potential liability protections under the Comprehensive Environmental Response, Compensation, and Liability Act. 78 Fed. Reg. 79,319.

As a result, E1527-21 now stands as the baseline for Phase I Environmental Site Assessments. While the ASTM E1527-13 standard may still be appropriate in certain situations, as a general rule, individuals performing Phase I ESAs should ensure that their assessments are in compliance with the latest standard.
